This agreement is between betterACTnow and you, in your capacity as a betterACTnow Partner.
These terms apply to everyone joining the betterACTnow Partner Program after 31 March 2008. We reserve the right to change these terms and to make improvements to our website and videos when needed to improve the service we provide. When changes are made they will apply to agreements made from the time the changes are published on the betterACTnow website.
The main benefit for you as a Partner is that betterACTnow videos help your customers get more value from ACT! This encourages them to buy more licences, upgrade more often and promote ACT! through their business networks, all of which means more business for you.
We pay you commission on all orders from accounts registered with your unique Partner code. Two rates of commission apply: 25% for individual videos and 15% for a full suite of 12 videos. Commission is calculated after discounts have been applied and before any taxes are added (tax is currently payable on purchases made from the UK only). Commission is automatically allocated to your Partner account - you can watch it accumulate by logging onto betterACTnow.com. Commission is automatically paid quarterly each August, November, February and May. Payments are normally made by check, but other arrangements can be made if necessary.
We provide your customers with a full set of tools for managing their video subscriptions, so that you don’t have to get involved in this at all. We also provide them with online help and email support, plus a 24 x 365 helpline.
Your role is simply to promote betterACTnow to your customers, and we provide a set of logos, web links and other collateral to help you to do this, along with regular template newsletters that you can easily adapt and re-brand.
Of course, you also get full access to all 24 betterACTnow videos, each of which can be played any number of times for 12 months from first use (but only on the PC on which it is first played).
Last but not least, we provide you with online help, email support and a 24 x 365 helpline.
You pay the annual Partner fee displayed on our website, plus tax if applicable (tax currently applies for UK based Partners only).
The prices for video subscriptions are displayed on the betterACTnow website. Partner discount is currently 15% and applies for all orders from accounts registered with a Partner code. Bulk discount applies when more than one subscription is purchased for the same video, or for multiple subscriptions for a full suite, during a single transaction. Bulk discount rates are currently as follows: 10% for 2 videos/suites, 12.5% for 3 videos/suites, 15% for 4 videos/suites, 17.5% for 5 to 9 videos/suites and 20% for 10 or more videos/suites. Partner and bulk discounts are cumulative, so for instance the price of two subscriptions for the same video ordered in a single transaction from an account that was registered with a Partner code is calculated as 2*$70*85%*90% = $107.10. The final price for each transaction is clearly displayed on the card payment screen.
Membership of the Partner Program lasts for 12 months and is renewed each year upon payment of the annual fee. We will remind you when renewal is due.
If your membership expires, no commission will be allocated or paid until the renewal fee is paid.
You must take all reasonable steps to keep your betterACTnow password safe. You must never write it down or give it to anyone else. We will not accept any responsibility for the consequences of not following this standard good practice for password security. You must not record, copy or distribute betterACTnow videos in any format.
By agreeing to these terms you are also agreeing to take all reasonable steps to ensure that people to whom you may allocate video licences also comply with this agreement.
You are obliged to keep all customer information acquired as a result of participation in the betterACTnow Partner Programme securely and must never pass this information to a third party or use it for any purpose not related to betterACTnow. This obligation is permanent and does not cease if your membership of the betterACTnow Partner Program lapses.
To ensure that we can send your commission payments on time, you must confirm that the address we include in our welcome email is the address to which payments should be made. You must also let us know if this address changes.
We will always respect your relationship with your customers. Once your customers have used your unique Partner code to register for a betterACTnow account, we will never contact them unless they ask us to get in touch to resolve a problem. And if we do contact them for this reason we’ll make it clear that we’re only doing so as your betterACTnow Partner.
We strive to provide continuous access to our website and videos and we use resilient, industry strength web servers, streaming media servers and other modern technology to deliver our services. However, even the best technology isn’t perfect and there may be occasions where service is affected by technical problems beyond our control. If such cases arise we will use all of the resources available to restore normal service as soon as possible. If we need to perform essential maintenance we will keep any service interruptions to a minimum. Video playback should be smooth as long as broadband access speed is 2Mb/s or more. However, playback can occasionally be affected by the contention ratio supported by access providers or by internet congestion. We are committed to delivering the best service possible, but we hope you will understand that we can accept no liability if service is affected by events beyond our control.
We are confident that all of the information in our training videos is accurate. However, we accept no liability for any losses or damages that may arise from improper use of ACT!
Our website only creates cookies on your PC in order to enable your account management functions. We do not use cookies to identify visitors or to track activity on the website.
We use VeriSign, global leader in the field of secure internet communications, to protect your passwords, and your credit card details are also encrypted. Credit card details are not stored by us or our payment services provider but are used by our bank to complete each transaction.
We will store all of the other information you provide via our website securely and we will only contact you in the unlikely event that this is necessary for service continuity. We will never pass the contact information that you provide via this website to a third party.
